Who can register under the Special Marriage Act?

The Act provides a civil form of marriage that does not depend on a religious ceremony. It is used by couples from different religions, by couples who do not follow a religion, and by a Bangladeshi citizen marrying a foreign national.

Where a party follows a religion with its own marriage law, the Act requires that party to make a written declaration as part of the registration. The registrar will explain exactly what applies to you.

How interfaith marriage registration works

  • Both parties submit a notice of intended marriage to the Special Marriage Registrar.
  • The notice is published and a waiting period for objections applies (commonly 14 days).
  • If there is no valid objection, both parties and three witnesses attend, sign the declaration and the marriage is registered.
  • A marriage certificate is issued after registration.

Documents you should prepare

  • National ID card or passport for both parties
  • Birth certificate or other proof of age
  • Recent passport-size photographs
  • Proof of unmarried, divorced or widowed status where applicable
  • Identity documents of three witnesses

Why register?

A registered marriage gives both spouses documentary proof of the marriage for inheritance, bank, visa, passport, child registration and court matters. Without it, proving the marriage can be slow and disputed.
